An employer cannot be forced to pay back wages to the staff member acquitted of a criminal charge unless the prosecution itself was mala fide by a court, the Supreme Court has reiterated in a judgment. 

The judgment came on the appeal by a former Railway Mail Service employee, Raj Narain, who was placed under the suspension in 1979 on allegations of involvement in forged payments of the high-value money orders.

A department would be responsible for outstanding wages if it were discovered that the beginning of the criminal trial was in bad faith or with vague intentions ... For example, if an employee is involved in embezzlement or is abandoning asking and accepting illegal gratification, then the employer cannot be fined with full wages for the acquittal of the person by a criminal court, unless it is established that the accusation is malevolent, "noted a bank of judges L. Nageswara Rao and MR Shah in a recent verdict.


The court reasoned that an employee involved in a crime was unable to provide his services because of his prison imprisonment. The subsequent acquittal by an appellate court does not give the right to reimbursement of wages.

The sentence reached the appeal of a former employee of the railway mail service, Raj Narain, who was suspended in 1979 on charges of participating in false high-value postal money orders.

An FIR was presented against him at the Mughalsarai police station. The suspension order was revoked in 1987, under which he took up his post and worked until 1997, when he was fired for his conviction for crimes, including the breach of trust and deception. He was sentenced to prison for three years. However, he was acquitted by an appeals court in 2002

Sportswear Giant Tap Indian Firm’s PET Project To Cut Virgin Plastic Use

The Global sportswear giant Adidas aims at eliminating the use of the virgin plastics in its products by the year 2024. The PET bottles are the main contributors to plastic waste globally and also in India.

But, As per the United Nations Report, approx 300 million tonnes of plastic are produced every year. And 8 millions of plastic waste end ups in the oceans. However, the PET material collection rate in India is approx 80%, among the best in the world, but a good portion of these bottles are downcycled, eliminating the possibility of further recycling.

Suspension of LoC Trade Between J&K And PoJK




MHA has issued some orders to suspend the LoC trade in Jammu & Kashmir w.e.f 19th April. This action has been taken as the Government of India has been receiving reports that the Cross LoC trade routes are being misused by the Pakistan based elements for various anti-national activities.

It is meant to facilitate the exchange of goods of common use between the local populations across the LoC in Jammu & Kashmir. The trade is allowed through 2 Trade Facilitation Centres located at Salamabad & Chakan-da-Bagh. In fact, the trade takes place four days a week. Trade is based on the Barter system and zero duty basis.

The Legislative Assembly And Article 333

The provisions of the article 333, the Legislative Assembly of each State will consist of not more than five hundred, and not less than sixty, members chosen by the direct election from territorial constituencies in the State.

For the purposes of clause (1), each State shall be divided into territorial constituencies in such manner that the ratio between the populace of each constituency and the number of seats allotted to it shall, so far as practicable, be the same throughout the State.
